HC moved seeking vacation of Dec 17 order on Assembly decision, next hearing on Jan 4

GUWAHATI, Dec 22: An application was moved in the Gauhati High Court yesterday by the Deputy Speaker of Arunachal Pradesh Assembly seeking vacation/modification of the HC’s December 17 order keeping in abeyance the decisions of the House passed in the "session" held on December 16 "removing" Speaker Nabam Rebia. Justice B K Sarmah issued directions not to hold any session of the Assembly till January four, 2016 after hearing a batch of interlocutory application filed by Deputy Speaker T Norbu Thongdok, who is opposed to Chief Minister Nabam Tuki, and some MLAs.

Justice B K. Sarmah gave the directions after hearing the interlocutory applications for modification of the earlier interim order passed on December 17.

After hearing the case, Justice Sarmah fixed January four 2016 as the date for the next hearing and till then directed not to hold the Assembly session.

On December 17, Justice Hrishikesh Roy of the HC, after hearing the writ petition filed by Rebia against the notification of the Governor preponing the Assembly "session", had also observed that the decision of the Governor "reflects the non-neutral role of the constitutional head and this is undermining the democratic process".

Justice Roy had passed the order while staying the Governor’s notification and the Deputy Speaker’s action in convening the Assembly in whose "proceedings" the Speaker was "removed", Chief Minister was "voted out" and a new CM "elected".

The ground taken in the interlocutory application was that under Article 212 the proceedings of any legislature of a state cannot be interfered with by the court. The court interfered by its interim order of December 17 keeping in abeyance the decision(s) of the session held on December 16, 2015, the applicants stated. PTI

Tuki extends olive branch to rebels

NEW DELHI, Dec 22: In a fresh bid to resolve the political turmoil in his state, Arunachal Pradesh Chief Minister Nabam Tuki has sought to reach out to rebel Congress legislators, saying he is ready to discuss and address all their “genuine grievances”.

In an interview to Hindustan Times, Tuki also said he had “enough evidence” to prove that the BJP had “orchestrated the defections” in the Congress and allegedly “used the office of the governor to topple a democratically-elected government” in the sensitive state bordering China.

“After all, rebel MLAs are part of the Congress family and have been misled by BJP. They should realise their mistake and work to strengthen the Congress in the state,” he said, adding, “I have nothing against them.”

Tuki’s offer to the rebels came on a day the Gauhati high court decided to hear on January 4 the matter related to the political crisis in Arunachal Pradesh.

The high court in an interim order earlier had kept in abeyance governor JP Rajkhowa’s move to advance the session from January 14, 2016, to December 16, 2015, and the subsequent developments that saw 21 Congress legislators and 11 BJP MLAs meet at a community hall in Itanagar and “impeach” Speaker Nabam Rebia after the state government had sealed the assembly premises for two days.

The next day on December 18, 33 legislators of the 60-member House met at a hotel and passed a “no-trust motion” against Tuki and “elected” dissident leader Kalikho Pul as the “new chief minister” of the state.

Tuki also claimed to have recorded conversations between Pul and a businessman in which the two are discussing the “imminent fall” of the Congress government.

Chaos and the keys

[ Tongam Rina ]

When Governor of Arunachal Pradesh J P Rajkhowa had issued orders advancing the session of the Arunachal Pradesh Legislative Assembly from Jan 14-18, 2016 to Dec 16-18, he probably did not realize that he would not only land himself in a soup but provoke a political drama and utter chaos, never witnessed before in the state.

Because of Rajkhowa's over enthusiastic move, Arunachal had no Speaker for more than 24 hours and for couple of hours, there were two Chief Ministers! The terror of having to handle two chief ministers did not last long due to the intervention of the High Court but we know that the current CM does not have enough support.  Then again there is the issue of disqualification of 14 members. It's never been this chaotic.

During two days of uncertainty,  the State Police and administration stood composed even in the face of provocation from BJP and Congress workers. Had one lathi been lifted, there would have  been violence because both parties were waiting for the other one to start. On the other hand,  Congress leadership and their supporters could have done better than blocking the highway and slaughtering a poor animal near the Raj Bhavan after the CM was 'voted out' in a sitting held in a hotel.

The display of political immaturity and hunger for power by Congress and rebel Congress and BJP have surely gone  down in political history of this state so has the actions of the overzealous governor who seemed to have exceeded his authority.

Now, we have to wait for  Jan 4, 2016 to find out what happens next, but we do know that self- centred  elected representatives need to do better to gain our confidence again. Yours truly will reserve her comments on  not so neutral governor and those workers who bared themselves. Till the judiciary tells us what has to be done, one wonders where the  keys of Legislative Assembly gate and Hall are.

Apparently, Nabam Rebia has the keys to the gate and T N Thongdok has the keys to the assembly hall. As of now, it's suspended animation. Have a blessed Christmas!

Parliament passes bill to reduce Juvenile age to 16 years

ITANAGAR, Dec 22: Juveniles aged 16 years and above will now be tried under laws for adults for heinous crimes as Parliament today passed a much-expected bill in this regard against the backdrop of a juvenile convict being released in the gangrape-cum-murder case of December 2012.

The Juvenile Justice (Care and Protection of Children) Bill, which provides for lowering the age for trial from 18 years, was passed by Rajya Sabha with a voice vote after a walkout by Left parties which wanted it to be sent to a Select Committee. The bill was passed by Lok Sabha earlier.

Replying to the debate on the bill, Women and Child Development (WCD) Minister Maneka Gandhi said the legislation was a "nuanced" one and was much needed to act as a "deterrent".

She said the incidents of heinous crimes by juveniles of the age of 16 years and above were on the rise and cited statistics to support her contention.

Allaying concerns expressed by members about the implications of the proposed legislation, Gandhi said it was "not against children but rather provides for, protects, nurtures and keeps them safe."

While CPI(M) members led by Sitaram Yechury staged a walkout demanding that the Bill be sent to a Select Committee, most of the other parties including Congress welcomed the passing of the legislation. The bill was taken up against the backdrop of uproar over release of juvenile convict in the heinous gangrape-cum-murder of a 23-year-old girl on December 16, 2012. Parents of the victim have said that the convict could escape after spending three years in a correction home only because the law is weak. PTI

BJD MP enquires about fate of his

motion on Arunachal Governor

NEW DELHI, Dec 22: BJD leader B Mahtab today raised the issue of Arunachal Pradesh governor's conduct and enquired about the fate of a 'substantive motion' he had moved in the Lok Sabha for a discussion on the issue.

Minister of State for Home Kiren Rijiju, an MP from the state, objected to it, saying the matter was in the court, even as Minister of State for Parliamentary Affairs Rajiv Pratap Rudy was seen asking him not to speak.

A substantive motion is a self-contained independent proposal submitted for the approval of the House and drafted in such a way as to be capable of expressing a decision of the House, like all resolutions. Mahtab said the matter of Governor Jyoti Prasad Rajkhowa's action in the state was not in the court. The recent developments saw rebel Congress MLAs joining hands with BJP in passing a no-confidence motion against Chief Minister Nabam Tuki, with the Gauhati High Court staying the proceedings.

Speaker Sumitra Mahajan said the matter was under her consideration and she will soon take a decision, as the BJD leader noted that time was short with the Session getting over tomorrow. PTI

State development in full swing, asserts Gadi

ITANAGAR, Dec 22: Taking a dig at opposition BJP and dissident MLAs, who have been alleging that Chief Minister Nabam Tuki-led Arunachal Pradesh Govt did nothing tangible, PWD Minister Gojen Gadi today tried to prove the achievements with documentary evidences.

Gadi said that the progress of Mini Secretariat Buildings (MSBs) and Cement Concrete Roads (CCRs) are highly satisfactory with the PWD making all possible efforts.

The percent-wise progress of MSB included Namsai (Phase-1) (95%), Changlang (65%), Sagalee (50%) and Khonsa (30%), the tendering process for Daporijo and Ziro MSBs is on while for Roing and Tezu the financial bids opened are under scrutiny, Gadi disclosed.

The percent-wise completion of CCRs included Capital Complex (80%), Ziro (30%), Aalo (phase-I) (80%), Yingkiong (phase-I) (80%), Pasighat (phase-I) and Roing (40% each), Longding, Khonsa and Changlang (35% each) and work at Tezu awarded a month back.

While the MSBs are built under special plan assistance allocated in 2013-14 and 2014-15, all CCRs are state flagship programmes, he said, adding that work has been taken up in district and ADC HQs to improve road connectivity on need-basis for which the state government had allocated Rs 30 crore in the last Budget.

Stressing on the cooperation of the people, Gadi said that the reconstruction of 218.5-mtr steel Suspension Bridge over Siang at Nubo funded by DoNER has been completed and would be inaugurated soon.

When asked about the dilapidated condition of the Capital Complex road, Gadi admitted of receiving numerous complaints. But he reasoned that the GoI wanted but failed to float the tender and entrusted the responsibility to PWD CE. But non-availability of hot mixture plant with the contractor delayed the process. The plant is expected to arrive here tonight and made functional within few days to begin full-fledged work. However, the DPR for developing the four-lane with CCRs would be submitted to Union MoRTH within December to expedite the process, he disclosed.

The PWD has a target to accomplish all the MSBs and CCRs by March 31 next, he said.

Recalling that the Union MoS (Finance) Jayant Sinha on November 2 last after reviewing state financial position here had certified the GoAP’s fiscal management as excellent, the allegations of financial mismanagement by various quarters hold no ground, Gadi argued.

DDCA scam haunting finance minister

The alleged financial irregularity under Delhi and District Cricket Association (DDCA) is starting to haunt finance minister Arun Jaitely.  The opposition parties are demanding his resignation over the allegation. Congress leader Ghulam Nabi Azad today urged Jaitley to resign, so that investigation is done freely. He added that finance minister can return to cabinet if he is proved innocent. Delhi Chief Minister Arvind Kejriwal took the matter to another level and demanded Prime Minister Narendra Modi's resignation alleging that Modi used CBI to conduct fraudulent raid in his office to save Arun Jaitley.

Embarrassingly for the saffron party, it is the BJP MP Kirti Azad who is up in arm against Jaitely. Azad has been leveling allegations of financial mismanagement in the Delhi and District Cricket Association during Arun Jaitley's tenure. Besides addressing a press conference in this issue, he also raised the matter in the Lokh Sabha much to embarrassment of BJP. The functioning of Rajya Sabha and Lokh Sabha was also disrupted on this issue. Opposition has been making noise in both the houses seeking resignation of Jaitely.  The DDCA scam is not only hurting the image of Jaitley but also that of the government. He is a senior minister and one of the trusted lieutenants of PM Modi. When he is under scanner, it directly affects the image of entire cabinet including that of Modi. Opposition parties are using him to target PM Modi. They are trying to create an impression that Modi is saving a wrongdoer. Therefore BJP will have to take a decision in this regard at the earliest before opposition wins the perception battle.

Need for PGT Commerce

Dear Editor,

I would like to place an open letter to the Director Secondary Education, Government of Arunachal Pradesh with regard to the recent advertisement No. ED-2/DSE/290/APT/2015 Dated, Itanagar the 10th Sep.’2015 and Govt. Order vide No. ED-2/DSE/234/2014-15 Dated, Itanagar the 28th Oct.’2015; specifically, of Trained Graduate Teacher (TGT) in Commerce.

We know that TGT or JT (Jr. Teacher) is basically teacher at Upper Primary Schools or Secondary level Schools which is not meant for Higher Secondary Level Schools. But unfortunately it is being observed that TGT in commerce have been advertised a couple of time recently. Whereas there is no subjects available like Accountancy and Business Administration at that level.

Astoundingly, after having telephonically talk with a person in Director Elementary Office phone No.03602290463 dated 10th Nov.’2015 11:00 hrs; I come to know that selected TGT in commerce would be teaching either Mathematics or Science at Upper Primary Schools.

The above stated matters and advertisement show that there is gross violation of Human Resource Development Index. As a matter of fact, Human Resource Planning is the process including forecasting, implementing, and controlling by which a firm ensures that it has the right number of people and right kind of people, at the right time and right place, doing things for which they are economically most suitable. It is basically the most effective utilisation of scarce talent in the interest of the labour and the organisation. If these linkages are not proper, a subsystem’s contribution to the achievement of organisational objectives is adversely affected. The same thing is certain to happen in coming days if manpower planning is not done properly.

From all the corners of the districts, we came across through daily newspapers with regard to subject teachers at Higher Secondary Level; there is immediate need of Post Graduate Teachers at almost all these Schools.

But department concern kept on advertising TGT in commerce. Why? It is known to all that only PGT or ST level subjects are available in commerce stream. So, Commerce department needs Post Graduate Teacher not TGT.

Finally, it’s my fervent appeal to kindly make and arrange to advertise the PGT post instead of TGT.

Yours,

T. Tangam

Do not involve in politics

Dear Editor,

This is regarding “Adisu to start agitation against Governor and MoS” published in your newspaper on 19th December.

It is my sincere appeal to the Adisu not to organize any rally in this hour of political crisis. Do not add more fuel to this political crisis. If you do any rally in this current situation everyone will call you as political organization and not a student union.

Adisu is considered as highest student organizations body of Adi community, so you have a big responsibility towards the society. Do not lead the union in favor of some political party as well as your own benefits because this union is not a political wing.

What other student unions do that doesn’t matter; let them do do not lower the dignity of the Adis by involving in such dirty politics. Do not lead the union in wrong directions rather than go for developmental activities.

Adi Bane Kebang(ABK) is there to handle any problem or issues. Before you declare agitation you should consult with the ABK first.

Students unions have a boundary and they shouldn’t cross their limit.

In addition to this, I request APMCC not to repeat semi nude protest. Instead of semi nude, you can adopt alternate methods. Your half nude protest was out of context

Yours,

Obang Mize

Jomlo Mongku,
